This document aims to regulate the TERMS OF USE and safeguard the PROTECTION OF USERS of www.hotelniunit.com, owned by HOTEL & SPA NIUNIT (hereinafter Hotel Niunit), with registered address at Ctra. General del Serrat s/n CP: AD300 El Serrat (Andorra). The terms “You” and “User” are used here to refer to all individuals and/or entities that access this website for any reason. Hotel Niunit intends, through www.www.hotelniunit.com/.com, to bring Hotel Niunit closer to users, providing them with information related to our services.
1. GENERAL CONDITIONS AND THEIR ACCEPTANCE
These general terms and conditions (hereinafter, the "General Terms and Conditions") govern the use of the internet portal service "www.www.hotelniunit.com/.com" (hereinafter, the "Portal") that Hotel Niunit, SL. (hereinafter, "Hotel Niunit") makes available free of charge to internet users. Use of the Portal confers the status of Portal user (hereinafter, the "User") and implies the User's full and unreserved acceptance of each and every one of the General Terms and Conditions in the version published by Hotel Niunit at the time the User accesses the Portal. Consequently, the User must carefully read the General Terms and Conditions each time they intend to use the Portal. The use of certain services offered to Users through the Portal is subject to specific terms and conditions which, as applicable, replace, supplement, and/or modify the General Terms and Conditions (hereinafter, the "Specific Terms and Conditions"). Therefore, prior to using such services, the User must also carefully read the corresponding Specific Terms and Conditions. Likewise, the use of the Service is also subject to all notices, rules of use and instructions made known to the User by Hotel Niunit, which complement the provisions of these General Conditions insofar as they do not conflict with them.
2. OBJECT
Through the Portal, Hotel Niunit provides Users with access to and use of various services and content made available to Users by Hotel Niunit or by third-party users of the Portal and/or third-party service and content providers (hereinafter, the "Services"). Hotel Niunit reserves the right to unilaterally modify, at any time and without prior notice, the presentation and configuration of the Portal, as well as the Services and the conditions required to use the Portal and the Services.
3. CONDITIONS OF ACCESS AND USE OF THE PORTAL
3.1 Free access and use of the Portal
The Portal service provided by Hotel Niunit is free of charge for Users and does not require prior subscription or registration. However, the use of some Services may require User subscription or registration and/or payment of a fee, as expressly indicated in their corresponding Specific Terms and Conditions.
3.2 Obligation to make proper use of the Portal and the Services
The User agrees to use the Portal and the Services in accordance with the law, these General Terms and Conditions, as well as generally accepted moral standards and public order. The User agrees to refrain from using the Portal and the Services for any unlawful purpose or effect, contrary to these General Terms and Conditions, harmful to the rights and interests of third parties, or that may in any way damage, disable, overload, or impair the Portal and the Services or prevent the normal use or enjoyment of the Portal and the Services by other Users.
3.3. Means for obtaining content
The User must refrain from obtaining or even attempting to obtain information, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any kind of material accessible through the Portal or the Services (hereinafter, the "Content") using means or procedures other than those that, as the case may be, have been made available to him for this purpose or have been indicated for this purpose on the Web pages where the Content is located or, in general, those that are commonly used on the Internet for this purpose, provided that they do not entail a risk of damage or disablement of the Portal, the Services and/or the Content.
3.4. Correct Use of Content

3.5. Introduction of hyperlinks that allow access to the Portal's Web pages and Services
Users and, in general, those who intend to establish a hyperlink between their website and the Portal (hereinafter, the "Hyperlink") must comply with the following conditions:
The Hyperlink will only allow access to the Portal's Web pages, but may not reproduce them in any way; Hyperlinks will not be established to any Web pages of the Portal other than the home page or first page of the Portal or the Services; A browser or border environment will not be created around the Web pages of the Portal; No false, inaccurate, or incorrect statements or indications will be made about the Web pages of the Portal and the Services, and in particular, it will not be stated or implied that Hotel Niunit has authorized the Hyperlink or that it has supervised or assumed in any way the content or services offered or made available on the Web page where the Hyperlink is established; Except for those signs that form part of the Hyperlink itself, the Web page where the Hyperlink is established will not contain any trademark, trade name, business name, designation, logo, slogan, or other distinctive signs belonging to Hotel Niunit; The website on which the hyperlink is placed shall not contain any illegal information or content, nor any content that is contrary to generally accepted morals and good customs or to public order, nor any content that infringes upon the rights of third parties. The placement of the hyperlink does not imply, under any circumstances, the existence of a relationship between Hotel Niunit and the owner of the website on which it is placed, nor does it imply Hotel Niunit's acceptance or approval of its content or services.
4. PERSONAL DATA
To use some of the Services, Users must first provide Hotel Niunit with certain personal data (hereinafter, the "Personal Data"). Hotel Niunit will process the Personal Data automatically for the purposes and under the conditions defined in its Data Protection Policy (PRIVACY POLICY).
5. RESPONSIBILITY FOR THE INTRODUCTION OF PERSONAL DATA
Users acknowledge that Hotel Niunit will be exempt from liability for the inclusion of inaccurate, false, outdated, or generally untrue personal data. Similarly, Hotel Niunit will be exempt from liability for the declaration of real data by a person not associated with them.
6. USE OF THE PORTAL, SERVICES AND CONTENT IS THE SOLE RESPONSIBILITY OF THE USER
The User is aware and voluntarily accepts that the use of the Portal, the Services and the Content takes place, in any case, under their sole and exclusive responsibility.
7. EXCLUSION OF WARRANTIES AND LIABILITY
7.1 Exclusion of warranties and liability for the operation of the Portal and the Services
7.1.1 Availability, Continuity, Usefulness, and Reliability. Hotel Niunit does not guarantee the availability and continuity of the Portal and Services. When reasonably possible, Hotel Niunit will provide prior notice of any interruptions in the operation of the Portal and Services. Hotel Niunit also does not guarantee the usefulness of the Portal and Services for any particular activity, nor their infallibility, and in particular, though not exclusively, that Users will be able to effectively use the Portal and Services, access the various web pages that make up the Portal, or those from which the Services are provided.
Hotel Niunit EXCLUDES ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MAY ARISE FROM THE LACK OF AVAILABILITY OR CONTINUITY OF THE OPERATION OF THE PORTAL AND THE SERVICES, FROM THE LOSS OF THE BENEFIT THAT USERS MAY HAVE ATTRIBUTED TO THE PORTAL AND THE SERVICES, FROM THE UNRELIABILITY OF THE PORTAL AND THE SERVICES, AND IN PARTICULAR, ALTHOUGH NOT EXCLUSIVELY, FROM FAILURES IN ACCESS TO THE DIFFERENT WEB PAGES OF THE PORTAL OR THOSE FROM WHICH THE SERVICES ARE PROVIDED.
7.1.2 Privacy and security in the use of the Portal and the Services Hotel Niunit does not guarantee the privacy and security of the use of the Portal and the Services and, in particular, does not guarantee that unauthorized third parties cannot become aware of the type, conditions, characteristics and circumstances of the use that Users make of the Portal and the Services.
Hotel Niunit EXCLUDES ALL LIABILITY FOR DAMAGES OF ANY KIND THAT MAY ARISE FROM UNAUTHORIZED THIRD PARTIES BEING AWARE OF THE TYPE, CONDITIONS, CHARACTERISTICS AND CIRCUMSTANCES OF THE USE THAT USERS MAKE OF THE PORTAL AND THE SERVICES.
7.2 Exclusion of warranties and liability for the Content
7.2.1 Quality Hotel Niunit does not control or guarantee the absence of viruses or other elements in the Content that may cause alterations in your computer system (software and hardware) or in the electronic documents and files stored in your computer system.
Hotel Niunit EXCLUDES ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MAY BE DUE TO THE PRESENCE OF VIRUSES OR THE PRESENCE OF OTHER ELEMENTS IN THE CONTENT THAT MAY CAUSE ALTERATIONS IN THE COMPUTER SYSTEM, ELECTRONIC DOCUMENTS OR FILES OF USERS.
7.2.2 Legality, reliability and usefulness Hotel Niunit does not guarantee the legality, reliability and usefulness of the Content. Hotel Niunit EXCLUDES ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MAY ARISE FROM THE TRANSMISSION, DISSEMINATION, STORAGE, PROVISION, RECEPTION, OBTAINING OR ACCESS TO THE CONTENTS, AND IN PARTICULAR, ALTHOUGH NOT EXCLUSIVELY, FOR DAMAGES THAT MAY ARISE FROM THE FAILURE TO COMPLY WITH THE LAW, MORALITY AND GENERALLY ACCEPTED GOOD CUSTOMS OR PUBLIC ORDER AS A CONSEQUENCE OF THE TRANSMISSION, DISSEMINATION, STORAGE, PROVISION, RECEPTION, OBTAINING OR ACCESS TO THE CONTENTS; The infringement of intellectual and industrial property rights, trade secrets, contractual commitments of any kind, the rights to honor, personal and family privacy and the image of persons, property rights and all other rights belonging to a third party as a consequence of the transmission, dissemination, storage, making available, receipt, obtaining or access to the content; the performance of acts of unfair competition and illegal advertising as a consequence of the transmission, dissemination, storage, making available, receipt, obtaining or access to the content; THE LACK OF TRUTHFULNESS, ACCURACY, COMPLETENESS, RELEVANCE AND/OR CURRENTNESS OF THE CONTENT; THE INADEQUACY FOR ANY KIND OF PURPOSE AND THE FRAUD OF EXPECTATIONS GENERATED BY THE CONTENT; THE BREACH, DELAY IN PERFORMANCE, DEFECTIVE PERFORMANCE OR TERMINATION FOR ANY CAUSE OF THE OBLIGATIONS CONTRACTED BY THIRD PARTIES AND CONTRACTS MADE WITH THIRD PARTIES THROUGH OR AS A RESULT OF ACCESS TO THE CONTENT; ALL VICES AND DEFECTS OF ANY KIND IN THE CONTENT TRANSMITTED, DISTRIBUTED, STORED, MADE AVAILABLE, OR OTHERWISE TRANSMITTED OR MADE AVAILABLE, RECEIVED, OBTAINED, OR ACCESSED THROUGH THE PORTAL OR THE SERVICES. 7.2.3 Truthfulness, Accuracy, Completeness, and Timeliness Hotel Niunit does not guarantee the truthfulness, accuracy, completeness, or timeliness of the Content. Hotel Niunit EXCLUDES ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MAY ARISE FROM THE LACK OF TRUTHFULNESS, ACCURACY, COMPLETENESS, AND/OR TIMELINESS OF THE CONTENT.
7.3 Exclusion of warranties and liability for services provided by third parties through the Portal
7.3.1 CalidadHotel Niunit does not control or guarantee the absence of viruses or other elements in the services provided by third parties through the Portal that may cause alterations in your computer system (software and hardware) or in the electronic documents and files stored in your computer system. Hotel Niunit EXCLUDES ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MAY ARISE FROM THE PRESENCE OF VIRUSES OR OTHER HARMFUL ELEMENTS IN SERVICES PROVIDED BY THIRD PARTIES THROUGH THE PORTAL THAT MAY CAUSE ALTERATIONS TO USERS' COMPUTER SYSTEMS, ELECTRONIC DOCUMENTS, OR FILES. 7.3.2 Legality, Reliability, and Usefulness Hotel Niunit does not guarantee the legality, reliability, or usefulness of the services provided by third parties through the Portal. Hotel Niunit EXCLUDES ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MAY ARISE FROM SERVICES PROVIDED BY THIRD PARTIES THROUGH THE PORTAL, AND IN PARTICULAR, ALTHOUGH NOT EXCLUSIVELY, FOR DAMAGES THAT MAY ARISE FROM THE BREACH OF THE LAW, MORALITY AND GENERALLY ACCEPTED GOOD CUSTOMS OR PUBLIC ORDER AS A CONSEQUENCE OF THE PROVISION OF SERVICES BY THIRD PARTIES THROUGH THE PORTAL; The infringement of intellectual and industrial property rights, trade secrets, contractual obligations of any kind, the rights to honor, personal and family privacy and the image of persons, property rights and all other rights belonging to a third party as a consequence of the provision of services by third parties through the portal; the performance of acts of unfair competition and illegal advertising as a consequence of the provision of services by third parties through the portal; THE LACK OF TRUTHFULNESS, ACCURACY, COMPLETENESS, RELEVANCE AND/OR CURRENTNESS OF THE CONTENT TRANSMITTED, DISSEMINATED, STORED, RECEIVED, OBTAINED, MADE AVAILABLE OR ACCESSIBLE THROUGH THE SERVICES PROVIDED BY THIRD PARTIES THROUGH THE PORTAL; THE INADEQUACY FOR ANY KIND OF PURPOSE AND THE FRAUD OF EXPECTATIONS GENERATED BY THE SERVICES PROVIDED BY THIRD PARTIES THROUGH THE PORTAL; THE BREACH, DELAY IN PERFORMANCE, DEFECTIVE PERFORMANCE OR TERMINATION FOR ANY CAUSE OF THE OBLIGATIONS CONTRACTED BY THIRD PARTIES AND CONTRACTS MADE WITH THIRD PARTIES IN RELATION TO OR AS A RESULT OF THE PROVISION OF SERVICES THROUGH THE PORTAL; THE VICES AND DEFECTS OF ALL KINDS OF THE SERVICES PROVIDED BY THIRD PARTIES THROUGH THE PORTAL.
7.4 Exclusion of warranties and liability for information, content and services hosted outside the Portal
The Portal provides Users with technical linking devices (such as, among others, links, banners, and buttons), directories, and search tools that allow Users to access websites belonging to and/or managed by third parties (hereinafter, "Linked Sites"). The sole purpose of installing these links, directories, and search tools on the Portal is to facilitate Users' search for and access to information, content, and services available on the Internet. Hotel Niunit does not offer or market, either directly or through third parties, the information, content, and services available on the Linked Sites, nor does it control, approve, monitor, or endorse them. The User, therefore, must exercise extreme caution in evaluating and using the information, content, and services available on Linked Sites. Hotel Niunit DOES NOT GUARANTEE OR ASSUME ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MAY ARISE FROM THE OPERATION, AVAILABILITY, ACCESSIBILITY, OR CONTINUITY OF LINKED SITES; THE MAINTENANCE OF THE INFORMATION, CONTENT, AND SERVICES AVAILABLE ON LINKED SITES; OR THE PROVISION OR TRANSMISSION OF THE INFORMATION, CONTENT, AND SERVICES AVAILABLE ON LINKED SITES. THE QUALITY, LEGALITY, RELIABILITY AND USEFULNESS OF THE INFORMATION, CONTENT AND SERVICES EXISTING ON LINKED SITES, UNDER THE SAME TERMS AND WITH THE SAME SCOPE AS SET FORTH IN THE GENERAL CONDITION
7.5 Exclusion of warranties and liability for the use of the Portal, the Services and the Content by Users
Hotel Niunit has no obligation to monitor, and does not monitor, the use that Users make of the Portal, the Services, and the Content. In particular, it does not guarantee that Users will use the Portal, the Services, and the Content in accordance with these General Terms and Conditions and, where applicable, the Specific Terms and Conditions that may apply, nor that they will do so diligently and prudently.
Hotel Niunit is not obligated to verify, and does not verify, the identity of Users, nor the truthfulness, validity, completeness, and/or authenticity of the data that Users provide about themselves to other Users. Hotel Niunit EXCLUDES ANY LIABILITY FOR DAMAGES OF ANY KIND THAT MAY ARISE FROM THE USE OF THE SERVICES AND CONTENT BY USERS OR THAT MAY ARISE FROM THE LACK OF TRUTHFULNESS, VALIDITY, COMPLETENESS, AND/OR AUTHENTICITY OF THE INFORMATION THAT USERS PROVIDE TO OTHER USERS ABOUT THEMSELVES, AND IN PARTICULAR, ALTHOUGH NOT EXCLUSIVELY, FOR DAMAGES OF ANY KIND THAT MAY ARISE FROM IDENTITY THEFT. FROM A THIRD PARTY MADE BY A USER IN ANY KIND OF COMMUNICATION CARRIED OUT THROUGH THE PORTAL.
8. NO LICENSE
Hotel Niunit does not grant any license or authorization of use of any kind regarding its industrial and intellectual property rights or any other property or right related to the Portal, the Services or the Content.
9. DENIAL AND WITHDRAWAL OF ACCESS TO THE PORTAL AND/OR SERVICES
Hotel Niunit reserves the right to deny or withdraw access to the Portal and/or the Services, at any time and without prior notice to those Users who fail to comply with these General Conditions or the applicable Particular Conditions.
10. PROCEDURE IN CASE OF CARRYING OUT ILLEGAL ACTIVITIES
If any User or a third party believes that there are facts or circumstances that reveal the unlawful nature of the use of any content and/or the performance of any activity on the Web pages included in or accessible through the Portal, and, in particular, the violation of intellectual or industrial property rights (patents, industrial designs and models, trademarks and trade names, etc.) or other rights, they must send a notification to Hotel Niunit containing the following information: Personal data: name, address, telephone number and email address of the claimant; Specification of the alleged unlawful activity carried out on the Portal and, in particular, when it is an alleged violation of rights, a precise and specific indication of the protected content as well as its location on the Web pages; Facts or circumstances that reveal the illicit nature of said activity. In the event of a rights violation, an authentic signature or equivalent, with the personal data of the holder of the allegedly infringed rights or of the person authorized to act on their behalf; an express and clear declaration, made under the claimant's responsibility, that the information provided in the notification is accurate and that the use of the content or the performance of the activities described is illicit. 11. DURATION AND TERMINATION
The provision of the Portal service and other Services is, in principle, for an indefinite period. However, Hotel Niunit is authorized to terminate or suspend the provision of the Portal service and/or any of the Services at any time, without prejudice to any provisions to the contrary in the corresponding Specific Terms and Conditions. When reasonably possible, Hotel Niunit will provide prior notice of the termination or suspension of the Portal service and other Services.
12. APPLICABLE LAW AND JURISDICTION
In the event of a claim between the two parties, it will be dealt with in the courts of the Principality of Andorra.
Use of the Portal confers the status of user and implies full and unreserved acceptance of each and every one of the provisions included in this legal notice.
